Agreement

This Dog Training Services Agreement (hereinafter referred to as the "Agreement") is entered into on the date this is signed and between Sirius Stamm doing business as Doggy Stars (hereinafter referred to as "we," "us," "our," "the website," or "Doggy Stars") and the dog owner (hereinafter referred to as "you" or "Owner"). This Agreement is intended to formalize the relationship between Doggy Stars and you and outline the scope of training services to be provided for the Owner's dog.

Doggy Stars' Responsibilities

Doggy Stars agrees to provide professional dog training services to you. These services may include, but are not limited to, obedience training, behavioral modification, and specialized training as agreed upon by both parties, as specified by you by booking on our website and confirmed by us to you by email or otherwise in writing.

Doggy Stars commits to maintaining the highest standards of professionalism and to adhere to ethical training practices. We further agree to utilize current, scientifically-supported training methodologies that prioritize the dog's welfare and psychological well-being.

Doggy Stars shall utilize positive reinforcement techniques, behavioral conditioning, and other humane methods of training. The Trainer explicitly agrees not to use techniques that cause undue physical or psychological distress to the dog.

However, there is no guarantee, implied or otherwise, that your dog will reach the desired level of training despite the efforts of Doggy Stars and any recommendation of a service or product by Doggy Stars does not guarantee satisfaction with that service or product.

Your Responsibilities

You represent and warrant than any information provided by you in this form is accurate to the best of your knowledge and you will promptly update us in the case of any changes in this information.

You agree to attend all scheduled sessions on time, actively participate in the training process, and follow through with Doggy Star's recommendations between sessions. You acknowledge that consistent practice between sessions is essential for your dog's progress.

You hereby certify that the dog is in good health and has received all necessary vaccinations as recommended by a licensed veterinarian. You agree to disclose any known health issues, behavioral concerns, or history of aggression prior to the commencement of training.

Fees & Payment

You agree to pay us the fees for the services as specified on our website or otherwise communicated by us when the classes or appointments are booked and confirmed by us. Fees must be paid at the time of booking the relevant service. Fees are non-refundable. Payment for packages is due in full prior to the commencement of the first session, unless otherwise agreed upon in writing.

Payments received more than 24 hours after the time of service or first session will incur a late fee of $25 or 10%, whichever is greater. Continual late payments may result in the termination of services at Doggy Stars's discretion.

Cancellation Policy​

For any private training sessions cancelled or missed by you:

• Sessions cancelled by you more than 72 hours in advance may be rescheduled one time.

• Sessions cancelled by you less than 72 hours in advance will be forfeited without refunds or fees.

• Cancellations due to emergencies will be handled on a case-by-case basis.

• Sessions expire based on the time listed on the website (e.g. 3 months) from the date of purchase and all sessions must be used by then or they will be forfeited without refund.

• In the event of severe weather that threatens the safety of you, your dog(s), or us, whether due to outside conditions or travel conditions, we reserve the right to reschedule the session.

Assumption of Risk & Liability Waiver

You acknowledge that dog training involves inherent risks, including but not limited to the risk of dog bites, scratches, property damage, or injuries to the Owner, Doggy Stars, or third parties. The Owner voluntarily assumes all such risks, both known and unknown, even if arising from the negligence of Doggy Stars or others, and assumes full responsibility for participation in the training program.

You hereby release, waive, discharge, and covenant not to sue Doggy Stars, their agents, employees, or affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Owner, the Owner's family members, or any third party, or to any property belonging to the Owner, whether caused by the negligence of Doggy Stars or otherwise, while participating in training services.

Termination

Either party may terminate this Agreement with written notice for the following reasons:

• Failure of the other party to comply with the terms of this Agreement;

• Unsafe behavior exhibited by the dog that poses a risk to humans or other animals;

• Determination by Doggy Stars that the dog's needs exceed the scope of Doggy

 

​Upon termination of this Agreement, you shall be responsible for payment of all services rendered up to the date of termination. Any prepaid fees for unused sessions will be refunded to you, less any applicable cancellation fees.

Entire Agreement

This Agreement and the services and bookings made through the website constitute the entire agreement between you and us with respect to the services provided by us to you and there are no other agreements, undertakings, representations, warranties or understandings, written or oral, express or implied. This Agreement may only be modified by an express written agreement, made after this Agreement has been executed, which both you and we have signed.

 

Severability

If any provision of this Agreement is held to be invalid or unenforceable, in whole or in part, the invalid or unenforceable provision or portion will be severed from this Agreement and will not affect the legality, validity or enforceability of any other provision of this Agreement.

 

Media Release

You consent to us taking photographs and videos of you and/or your dog and give Doggy Stars permission to publish in print, electronic or video format the likeness or image of you and/or your dog and basic information concerning your dog for the purposes of education, advertising, or promotion of Doggy Stars. You waive any right to inspect or approve the photographs or videos or their use and release all claims against Doggy Stars with respect to privacy rights, publicity rights, copyright ownership, and publication, including any claim for compensation related to use of the materials.
